Discover the Role
In this role you will lead and develop the TMF Group Guernsey compliance function for both the Fund Services Business and Trust Company Business and maintain and continuously improve a robust compliance framework, whilst supporting the Boards and Senior Management in enhancing the compliance culture. You will work closely with the Boards of Directors and Head of Risk & Compliance for Channel Islands in the successful delivery of the role.

Key Responsibilities

Compliance and Money Laundering Compliance responsibilities: 

  • Act as the appointed Compliance Officer and Money Laundering Compliance Officer for both the Fund Services Business and Trust Company Business;
  • Principal regulatory contact person with the GFSC;
  • Ensure the maintenance of the robust compliance framework with related policies to meet the local regulatory requirements, and introducing new policies as may be required for the licensees;
  • Ensuring that a consistent, proportionate, and risk based approached is applied to all compliance matters;
  • Accountable for the compliance function in its provision of compliance advice/support ensuring timely resolution of compliance issues;
  • Driving improvements in compliance awareness through the evaluation of needs, and delivering a training and development programme, with input from compliance monitoring program, and internal or external audits;
  • Ensuring the compliance function reviews all existing and new compliance policies to ensure that they continually meet regulatory and best practice requirements;
  • Building market and industry knowledge to benchmark compliance policies and practices;
  • Ensure effective action plans are made and implemented to address upcoming changes in local, or TMF Group policy, local regulation and industry best practice;
  • Ensuring the effective operation and delivery of a risk-based compliance monitoring program;
  • Assisting with the development and oversight of the risk-based client file review framework;
  • Delivering an annual compliance business plan to the Channel Island Boards/Risk Committee for agreement;
  • Establishing and maintaining appropriate mechanisms for the identification, monitoring and reporting on compliance matters to senior management, the board, committees and other relevant stakeholders;
  • To take ownership of the AML/ CFT/CPF business risk assessment and ensure effective review by the Board on a ongoing basis;
  • To act as manager for the team responsible for the compliance

MLRO responsibitlies: 

  • To act as MLRO for the TMF Guernsey licensees;
  • Receive and assess any reports made by the business concerning financial crime suspicions;
  • Make prompt disclosures to the FIS via their online portal if after considering a report there is knowledge or a suspicion of financial crime;
  • Maintain a record of all requests for information from law enforcement authorities and records relating to all internal and external client related SARs;
  • Manage relationships effectively post disclosures to avoid tipping off;
  • Act as the liaison point with the GFSC and the FIU and in any other external enquiries in relation to financial crime matters for TMF legal entities

Key Requirements
  • Ideally a minimum of 10 years’ experience in a Trust Company Business or Fund Services Business environment is preferred in risk and/or compliance roles;
  • Extensive knowledge of Guernsey regulatory requirements, including AML/CFT/CPF frameworks, with experience engaging directly with the GFSC and other regulatory bodies;
  • Demonstrated experience acting as, or being approved to act as, Compliance Officer, MLCO, and MLRO within a regulated environment;
  • Experience engaging with regulators (e.g. GFSC) and senior stakeholders; 
  • Good understanding of risk-based compliance and monitoring programmes;
  • Strong leadership, communication, and stakeholder management skills
  • Ability to deliver training and provide effective support to compliance teams and wider business functions
  • Ability to mentor and develop team members by setting clear, achievable objectives and supporting their growth
  • Relevant professional qualification (e.g. ICA, ACAMS) preferred;
  • Expertise in all MS Office packages (Word, PowerPoint, Excel, Outlook) and other software packages as appropriate and other software packages as appropriate
